Privacy Notice
Last updated: October 28, 2026
Swaypoint Inc. ("Swaypoint", "we", "us") provides a platform that businesses use to run AI-assisted messaging conversations with their customers. This notice explains how we handle personal information when you visit swaypoint.ai, contact us, or do business with us, and how our role differs when we process information on behalf of our business customers.
1. Our two roles
When we act for ourselves. For visitors to our website, people who contact us, and the business contacts of our customers, prospects and vendors, Swaypoint decides how personal information is used. This notice covers that information.
When we act for our customers. Businesses use the Swaypoint platform to send and receive messages with their own customers ("end users"). We process that information, such as phone numbers, message content and consent records, on the business's behalf and under our contract with it, as a service provider. The business's own privacy notice governs that information. If you received a message from a business using Swaypoint, contact that business with questions or requests. If you contact us instead, we will pass your request to the business.
2. Information we collect
- Information you send us. If you email us, we receive your name, email address and anything you include in your message.
- Business contact information. Names, job titles, business email addresses and phone numbers of people at our customers, prospects, partners and vendors, which they give us or which we receive in the ordinary course of business.
- Account information. When a customer uses the platform, we collect the account details of its authorized users (such as name, business email and login activity) to provide and secure the service.
- Technical information. When you visit swaypoint.ai, our hosting provider (Google Firebase Hosting) receives standard request data such as your IP address, browser type and the pages requested, and keeps it in server logs. The site loads fonts from Google Fonts, which also receives your IP address.
Our website does not currently use cookies, analytics or advertising trackers.
3. How we use information
We use personal information to:
- respond to your inquiries and communicate with you;
- provide, support, secure and improve our services;
- manage our business relationships, including contracts and billing;
- detect and prevent fraud, abuse and security incidents; and
- comply with law and enforce our agreements.
We do not use information we process for our customers for our own marketing, and we do not use it to train AI models that serve other customers without that customer's written permission.
4. Text messaging and mobile information
We do not sell, rent or share mobile phone numbers, or text message opt-in data and consent, with third parties or affiliates for their marketing or promotional purposes. The sharing described in section 5 excludes text message opt-in data and consent.
Where law or carrier rules require, Swaypoint keeps limited records of end-user opt-outs and consent (such as the phone number, time and keyword) to make sure opt-outs are honored. These records contain no message content.
5. How we share information
We share personal information only:
- with service providers that host, operate or support our services (for example, cloud hosting, email and productivity tools, and AI model providers), under contracts that limit their use of it to providing services to us;
- with our customers, for information we process on their behalf;
- for legal reasons, when required by valid legal process, or to protect the rights, safety and security of Swaypoint, our customers or others; and
- in a business transfer, such as a merger or acquisition, subject to this notice.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
6. Retention
We keep personal information only as long as needed for the purposes above, or as required by law or contract, and then delete it. Information we process for customers is kept according to their instructions and our contracts with them.
7. Security
We protect personal information with administrative, technical and physical safeguards appropriate to its sensitivity, including encryption in transit and at rest and restricted access. No system is perfectly secure.
8. Your rights
Depending on the US state where you live, you may have the right to:
- know what personal information we have collected about you, and get a copy;
- correct inaccurate information;
- delete your information; and
- not be discriminated against for exercising these rights.
We do not sell personal information or share it for targeted advertising, so there is nothing to opt out of.
To make a request, email privacy@swaypoint.ai. We will verify your request in proportion to the information involved and respond within the time the law requires (for California, 45 days). An authorized agent may make a request for you with proof of authorization. If we deny a request, we will explain why, and you may appeal by replying to our response.
9. Children
Our services are for businesses and are not directed to children. We do not knowingly collect personal information from children under 13.
10. Where we process information
Swaypoint is based in the United States, and we store and process personal information in the United States.
11. Changes
We may update this notice. We will post the new version here with a new "Last updated" date, and for material changes we will give additional notice where appropriate.
